Terms & Conditions

Overview 

This website is owned by The Riverina Hamper Co. By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by the following terms & conditions. These Terms & Conditions apply to all users of the site, including users who are browsers, customers, vendors, merchants, and/ or contributors of content. 

Please read these Terms & Conditions carefully before accessing or using our website. By accessing or using any part of this site, you agree to be bound by these Terms & Conditions. If you do not agree to all the Terms & Conditions of this agreement, then please decide not to access the website or use any services. 

 

Changes to our Terms & Conditions 

You can review the most current version of our Terms & Conditions at any time on this page. We reserve the right, at our discretion to update, change or replace any part/s of these Terms & Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of our website following the posting of any changes to these Terms & Conditions constitutes acceptance of those changes. 

 

Purchasing 

All prices quoted, unless otherwise stated, are inclusive of GST and are quoted in Australian dollars (AUD). Product prices do not include delivery fees and we reserve the right to amend our prices at any time. 

The Riverina Hamper Co.accepts various payment methods for online payments. When providing your credit card details, you are agreeing that you are authorised to use that card and it must have sufficient available funds to cover your charges. 

Gift hampers that include alcohol are only for sale to adults over the age of eighteen (18) years. By proceeding to purchase through our website, you acknowledge that you are over 18 years of age. Gift hampers containing alcohol may only be delivered and received to persons over the age of 18. Please see our “Sale of Alcohol” section in this agreement for more details. 

When you order from us, we may require you to provide personal details such as your name, home or business address, email address, phone number, credit card details and the receiver/s address/es for delivery. We undertake extreme care with this information and never forward on or sell your details to any third parties ever. 

Orders will not be dispatched until payment is received in full by The Riverina Hamper Co. unless credit terms have been agreed upon (generally for bulk orders only). 

 

Shipping 

It is your responsibility to provide accurate, clear and detailed information for the correct delivery of your purchase. The Riverina Hamper Co. takes no responsibility for information given incorrectly. Incorrect information can result in delays in delivery or your hamper being returned to us. For deliveries to business addresses, the business name must be included with your order. 

The Riverina Hamper Co. endeavour to deliver orders by or on the date requested. This however is not always possible due to unforeseen circumstances or events beyond our control. You agree that late delivery does not constitute a failure of our agreement and does not entitle you to cancel an order or receive a refund. 

Orders must be received by 9pm AEST for next business day delivery. Order cut off times will change during the busy Christmas period - Please refer to our delivery information page for more information during this time. 

We ship via Australia Post and other external freight providers. Our freight providers have been researched and chosen by us due to their ability to provide the fastest, most accurate and consistent delivery in Australia. We offer fixed rate shipping costs which are displayed at checkout. Our fixed rate is currently $9.95 for standard shipping Australia-wide or $19.95 for express shipping Australia-wide. We also offer FREE local delivery to Wagga Wagga, NSW And surrounding suburbs. This is automatically shown at checkout. Currently, we only ship within Australia. We may ship gifts using other carriers with or without notice from time to time. 

Delivery timeframes are dictated by our freight providers, however, please note that rare delays may occur due to unforeseen circumstances such as road or weather events and The Riverina Hamper Co. is not responsible for these delays. 

If a receiver is not home and a calling card is left at the address by the freight provider, it is the receiver’s responsibility to contact the courier to arrange appropriate delivery or pick up from the local Australia Post Office location advised on the card. If the parcel remains undeliverable due to no contact from the receiver, it will be returned to us at The Riverina Hamper Co. for a $15.00 fee which will be charged to the sender. Late delivery due to the receiver not being home does not constitute a failure of our agreement and does not entitle you to cancel the order or receive a refund. 

If you provide an incorrect, yet legitimate address and the hamper is successfully delivered, we cannot recall the hamper and will not be held responsible. We will not provide a refund in this circumstance and you will need to purchase another hamper should you wish to send another out. 

The Riverina Hamper Co. takes no responsibility for a receiver not accepting a delivery. The freight provider will return the order to us for a $15.00 fee which will be charged to the sender. Denied delivery by a recipient does not constitute a failure of our agreement and does not entitle you to cancel the order or receive a refund. 

If an order cannot be delivered due to inaccurate delivery details, it will be returned to us at The Riverina Hamper Co. and a $15.00 charge will be incurred at the expense of the sender. 

It is the sender’s responsibility to inform The Riverina Hamper Co. if an order has not arrived. 

Hampers cannot be re-directed while in transit and will need to be returned to us before being sent to the new/correct address. This incurs a $15.00 fee from the freight provider and will be passed on to the purchaser. 

No deliveries are made on weekends or public holidays (unless arrangements are made prior for local delivery to Wagga Wagga, NSW and surrounding suburbs). 

Gift hamper and delivery prices are subject to change without notice. 

 

Cancellation 

Where a product has been listed an incorrect price, or has incorrect written information or images, we reserve the right to cancel a transaction. The purchase amount will be refunded via the payment method used for the initial purchase. 

Once payment for an order has been accepted, cancellation is at the discretion of The Riverina Hamper Co.. If you wish to cancel your order, please contact The Riverina Hamper Co. immediately on 0479 083 544. 

Cancellation of orders must be made at least 24 hours prior to dispatch. Orders cannot be cancelled once they have been prepared and are with our couriers for delivery or have been processed by Australia Post. 

 

Returns 

The Riverina Hamper Co. takes no responsibility for any item being returned to us by a freight provider or receiver. We will inform you via phone and/or email when a hamper has been returned. The freight provider will return the order to us for a $15.00 fee which will be charged to the sender. A $15.00 re-delivery fee will then be charged to facilitate the delivery of the hamper to the same or an alternative address. 

Occasionally a hamper will be returned to us for one of the following reasons: 

  • a parcel has an incorrect address and our couriers are unable to call the recipient to verify; 

  • a card was left but there was no response from the recipient to arrange re-delivery; 

  • a card was left but the recipient did not pick the package up from the post office, newsagent or other specified location; 

  • the recipient is not known at that address or has moved; 

  • address details are incorrect or insufficient; 

  • the recipient has rejected delivery 

  • the recipient was in a hospital or a hotel and has been discharged or has checked out 

Due to the perishable nature of our hampers, we cannot accept returns if the hamper has been opened, successfully delivered to the wrong person or has a dispatch date of 30 days or more prior to you contacting us. 

We want you to be satisfied with your hamper, whether you are someone who has received one as a gift or the individual who placed the order. If you have any issues with our product you are obligated to call us on 0479 083 544 to seek a resolution. 

 

Refunds 

Refunds will not be given for late delivery outside our stipulated delivery guarantees. We will not be held liable for late delivery outside of our stated delivery commitment. 

Orders cannot be refunded once they are with our couriers for delivery. 

Due to the perishable nature of our hampers, we cannot process refunds or accept returns if the hamper has been opened, successfully delivered to the wrong person/address. 

In the event that you do not want a replacement hamper/item sent, we will refund the credit card used for the value of the total transaction or the value of the damaged items. 

The Riverina Hamper Co. does not refund for change of mind. 

 

Damaged items 

In the unfortunate event that your hamper or its contents arrive damaged or faulty, please contact us on 0479 083 544 or email us at hello@theriverinahamperco.com.au within five (5) business days of the arrival of the hamper. 

The Riverina Hamper Co. requires photo/s of all damaged items before a replacement hamper/item will be sent, so that we can better understand the extent of the damage or issues with the product. 

We reserve the right to decide what constitutes a damaged or faulty item. While we take great care in packing our hampers, products and packaging may shift in transport and this is not considered damaged or defective. 

If it is necessary for the product to be replaced, we will happily exchange or send a new hamper depending on the extent of the damage. 

 

Gift cards 

While we offer every customer a gift card with their choice of message, it is the sender’s responsibility to ensure that all names, greetings, logos and editing are correct. If you notice a mistake, contact us immediately on 0479 083 544 or email us at hello@theriverinahamperco.com.au 

Once an order has left our warehouse and is with a freight provider, a gift message cannot be changed. Your order will need to be returned to us before a message can be changed. Returning your order to The Riverina Hamper Co. incurs a $15.00 fee from the freight provider and will be passed on to the purchaser. A $15.00 re-delivery fee will then be charged to facilitate the delivery of the hamper to the same or an alternative address. 

The Riverina Hamper Co. takes no responsibility for incorrect card messages, spelling, grammar or business logos. 

 

Product Pricing 

Prices for our products are subject to change without notice. We reserve the right to modify or discontinue any product without notice at any time. 

The Riverina Hamper Co. is not liable to you or any third party for the discontinuance, modification or price change of a product line that you consider a representation of your business. 

 

Product Substitutions 

The Riverina Hamper Co. makes every effort to have stock available of all items, however in certain circumstances an item may not be available. If we are unable to supply an item, we reserve the right to make substitutions of items of equal or greater value as necessary to ensure timely delivery of your gifts. In the instance of product substitutions occurring, The Riverina Hamper Co. reserves the right to make these changes without contacting you the customer. 

We endeavour to ensure that our product list is current however we give no undertaking as to the availability of any product advertised on our website. 

 

Product Descriptions 

The Riverina Hamper Co. strives to ensure that our products are described as accurately as possible on our website, however typographical errors, inaccuracies or omissions that may relate to product description and, pricing may occur. 

Where a product has been listed at an incorrect price, has incorrect written information or images, we reserve the right to correct any errors, inaccuracies or omissions and to change or update information and cancel any orders due to this inaccurate information. 

 

Product Images 

For photographic purposes some products have been featured with additional props. Unless an item is listed as included in the hamper’s ingredients, it is not included in the hamper. 

 

Product Packaging 

Manufacturers may alter their packaging and ingredient lists without notice. Product packaging may differ from what is displayed on our website. 

 

Sale of Alcohol 

The Riverina Hamper Co. supports the responsible service of alcohol. According to Liquor & Gaming NSW A liquor licence is not required to sell alcohol that is included in the sale of a genuine gift to a person, such as a gift hamper;  

  • the alcohol included in the gift must be purchased from a retail liquor outlet 

  • two litres is the maximum volume of alcohol permitted in each gift 

  • the gift must be packaged and presented in such a manner that it would be taken to be a gift 

  • the gift can only be delivered to another adult who is not the purchaser 

  • gifts must be delivered between the hours of 7am to 7pm. 

If ordering a hamper/s containing alcohol, you confirm that you are over the age of 18 years. It is a legal requirement that the person placing the order is over the age of 18 and the person receiving the delivery is over the age of 18. 

 

Food Allergy Disclaimer 

The Riverina Hamper Co. does not create any of the food products sold in our hampers or on our website. Food products provided on our web site are produced and packaged by third-party companies and are labelled with possible allergen-containing ingredients by the manufacturer. You are encouraged to read the labels before consuming. The Riverina Hamper Co. will not assume any liability for adverse reactions to food consumed. 

 

Skin Allergy / Reactions Disclaimer 

The Riverina Hamper Co. does not create any of the skin, bath or cosmetic products sold in our hampers or on our website. Skin, bath and cosmetic products provided on our website are produced and packaged by third-party companies and may be labelled with possible allergen-containing ingredients by the manufacturer. You are encouraged to read the labels before using these products. The Riverina Hamper Co. will not assume any liability for adverse reactions to skin, bath or cosmetic products. 

 

External Links 

Once you have used a link to leave our site, you should note that we do not have any control over that website, and it is not governed by us. The Riverina Hamper Co. is not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party. 

 

Intellectual Property Rights 

The Riverina Hamper Co. owns or has license for the copyright of all content on this website including text, graphics, images, logos, layout and applets. Your use and access to this website does not license you to use or copy in anyway any logos, brands, trademarks or content on this website without our prior written permission. 

Any breach of these terms will be dealt with and legal action will be promptly taken. 

Any feedback, comments, messages, reviews, suggestions or ideas which you provide to us through this website, becomes our property. If in future, we use your Feedback on our website or in social media or marketing campaigns, in written or visual form, we will not be liable for any similarities which may appear from such use. Furthermore, you agree that we are entitled to use your feedback for any commercial or non-commercial purpose without compensation to you or to any other person who has transmitted your Feedback. 

 

Privacy Policy 

By providing The Riverina Hamper Co. with your personal information, you consent to the collection, storage and use of your personal information to enable us to provide you with our products and services. The Riverina Hamper Co. collects personal information only for the purpose of conducting our business and providing our products and services. 

The Riverina Hamper Co. does not sell or rent any personal Information to third parties ever. 

Unless required by law or we are investigating suspected fraud or other unlawful activity, the personal information collected by The Riverina Hamper Co. will only be disclosed to or seen and used by The Riverina Hamper Co. or for us, unless you have authorised us to do otherwise. 

We will pass on any information relating to suspected fraudulent activity to appropriate authorities. 

Subject to any legal restrictions on us, we are happy to inform you of what personal information we hold about you and how we manage your personal information. Corporate Bulk orders 

All our hampers are available to you under a corporate and/or bulk order arrangement. Hampers can be designed to suit your specific needs or can be from our ready-made range.  

You agree to pay minimum 50% deposit where required when placing your order, with the remaining amount due prior to dispatch. You agree to a notice period for all corporate or bulk orders. If corporate branding is required on packaging items, ribbons and gift cards, please call us on 0479 083 544 or email us on at hello@theriverinahamperco.com.au to discuss specific requirements, including branding, notice periods and deposits required 

You agree that as a corporate/bulk order customer, credit is being provided to you and that ownership of goods invoiced remains with The Riverina Hamper Co. and does not pass to you the purchaser until such time as payment is paid in full. 

Where Credit is extended to you the customer, you agree and accept that a late payment fee of $30.00 per month will be automatically applied if payment is not received within the time stipulated on the invoice provided to you the customer. 

We reserve the right to actively pursue collection of outstanding amounts, and any costs incurred by The Riverina Hamper Co. during this process, if any, will be passed on to you the customer. 

 

Force Majeure 

The Riverina Hamper Co. is not liable for failure to perform obligations, including but not limited to, the fulfilment and/or delivery of an order if an unforeseeable event occurs. If a Force Majeure event causing delay occurs, we may terminate this agreement. “Force Majeure” means any act, circumstance or omission over which The Riverina Hamper Co. could not reasonably have exercised control.
